4. Payment terms
- Payment terms will be highlighted within the respective quote or contract and will details whether Evolve Construction will invoice you on completion of the project or in instalments.
- Invoices are due within the payment terms stated on the invoice.
- Evolve construction reserves the right to put work on hold if payments are delayed, until such time as payment is received and cleared within the Evolve Construction bank account.
- Without limiting any of our other rights, if you fail to make any payments due to us by the due date as stated on the invoice due, we shall have the right to charge interest on the overdue amount. Such interest shall accrue daily from the due date until actual payment of the overdue amount. You shall pay the interest together with the overdue amount.
5. Cancellation policy
- Cancellations must be made in writing. It cannot be back-dated.
- If cancellation occurs within 10 working days of the scheduled start date, charges may apply for work already completed, site preparation, or materials ordered.
- In all cases, where you owe monies at the time of cancellation, you commit to pay the outstanding monies owed within seven working days.
- Evolve Construction will provide you with details of all work carried out in reaching settlement and will hand over all work completed up until the settlement date once
payment has been settled within ten working days. - Upon cancellation of contract by the client, Evolve Construction will issue the client with a final invoice which shall be due within seven working days and include:
– All outstanding charges due in accordance with payment terms.
6. liability
- We undertake to carry out all groundworks and associated services with reasonable skill, care, and in accordance with applicable industry standards and regulations.
- We are not liable for unforeseen or hidden conditions on-site, such as underground obstructions, utilities, poor soil quality, or contamination. Any additional work, delay, or cost arising from such conditions will be treated as a variation and may be subject to additional charges.
- We are not responsible for delays caused by factors beyond our control, including adverse weather, third-party contractors, supply chain issues, or other force majeure events. In such cases, agreed deadlines may be extended without penalty.
- While we take reasonable care to avoid damage, we are not liable for:
o Pre-existing structural weaknesses or poor ground conditions;
o Damage caused to underground services not clearly identified or marked;
o Damage to access routes, driveways, or landscaping necessary for site access, unless specifically excluded or protected by prior agreement. - We accept no responsibility or liability for the actions, delays, or failures of third-party contractors, utility providers, or other parties not directly under our control.
- We shall not be liable for any indirect, incidental, or consequential loss or damage including, but not limited to, loss of profits, loss of business, or increased project costs arising from or related to our services.
- Our total liability for any claim, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the total fee paid by the client for the specific services giving rise to the claim.
